Is playing poker online (real money) completely legal in all states?

There doesn't seem to be a concensus here. :)

What I am understanding is:
1. Playing poker for real money online "per se" is legal in most states.
2. Making a deposit via CC or e-check is not always legal... but that's between the banks and the website.
3. Some states DO have anti-gambling laws, but there has never been a conviction.

So... does that mean that if I were to gamble online, the whole process would NOT be completely legal, but I'm literally playing the odds that nobody will hunt me down and convict me of "illegal gambling?"

States with specific laws against online gambling are Michigan, Illinois, Louisiana, Oregon, Wisconsin, Washington, Indiana, Nevada, New York, New Jersey and South Dakota. Online poker played for money is considered gambling under these laws.

And for you, and all those other posters, there is a new development about online poker in a Kentucky Court - there have a court order seizing the domains of 141 online poker rooms, including PokerStars, Full Tilt, UltimateBet, Doyle's Room, Absolute Poker and others.

But there are some Online Poker Rooms that are actually 100% USA legal. Sites where US players can play online poker, can deposit and withdraw using standard credit cards, can get paid by US checks drawn on US banks and deposit these checks in their US bank account, and NOT be in violation of the UIGEA federal law. And best of all, in the event of a dispute, the US player has recourse and protection under US law!

The Fascinating History of Online Poker

Poker is a card game that has been played for quite a while. It is traditionally played in a casino or any gambling spot called a brick-and-mortar card room (also known as a B&M room). However, with the emergence of the internet, poker was not just limited to a B&M room. Because the internet lets you interact with other people in the comfort of your own home some people asked the question, "Why not "play" a poker game with other people in the comfort of your own home. Thus, online poker was born.

Online Poker started in the early 1990 but during those years the internet was not as exploited commercially as it is today. Online poker was more of a way to pass time rather than a serious business. However, in January 1998 the first poker game that offered real world money was played. Ever since the dot com boom of the 21st century, many more online poker websites have emerged and there are approximately 500 or more of these as of the moment. Although most of these sites share "networks" within each other, there are currently 16 stand alone websites. PokerStars.com is credited as being the world's largest poker site due to the sheer number of people playing poker at any given time.

Online poker has become so popular from the year 2000 to 2008; it has actually surpassed the number of real life players in the world. But because there are questions of legality and fear of online hacking and cheating, demand for new players have declined. To attract these new players to a poker website, companies hold tournaments called satellite tournaments.

If a person wins an online tournament, he or she may be invited to participate in a real life poker tournament for a chance to earn win real world money. The most famous person who has won a satellite tournament online and also won the real life tournament is Chris Moneymaker. He won the 2003 World Series of Poker Tournament and took home 2.5 million US dollars. In the 2004 World Series of Poker Tournament, there were three times more participants than the previous year and Greg Raymer who also won a satellite tournament, repeated the same feat as Moneymaker.

The middle part of the decade was a great time for online poker. In 2004, the largest publicly offered online gaming company at that time, Sportingbet, bought ParadisePoker.com to the amount of 340 Million US Dollars. Back then, ParadisePoker.com was the largest online card room and was also one of the first companies in the industry. In 2005, PartyGaming which is the parent company of PartyPoker, went public and achieved an initial public offering in excess of 8 Billion US Dollars.

Since then, online poker has declined in the number of people playing the game and also the revenue they collect. In fact, some online poker websites who were supposed to go public, postponed their plans indefinitely.
